This document serves as a guideline only. In the event of any dispute, the Terms and Conditions of use shall be governed by and construed in accordance with the law of France and you hereby submit to the exclusive juridsdiction of the French courts (Tribune de Bordeaux).

1. Acceptance of Terms
By clicking on the button ‘Send ’ you hereby accept the totality of the present Terms and Conditions of Use of the site “DAYLIGHTPHOTOGRAPHER”.
The prices of products and services are given in Euros and do not include tax: VAT is non-applicable pursuant to article 293B of CGI: code général des impots (General French tax laws).
Prices may be changed at any time without giving prior notice, and without incurring any responsibility for “DAYLIGHTPHOTOGRAPHER”. Only those prices indicated at the time of ordering shall be considered valid.
“DAYLIGHTPHOTOGRAPHER” reserves the right to neither confirm nor honour an order for which payment has not been received, or for any other reason without being under obligation to give a reason. “DAYLIGHTPHOTOGRAPHER” also reserves the right to refuse a reservation if photographer from our website isn’t available. The information given by the client via the online order forms serves as an engagement on behalf of the client. “DAYLIGHTPHOTOGRAPHER” will not be held responsible if an order cannot be completed due to errors in the completion of the aforementioned order form.
Payment is made online with a credit/debit card, via the secure payment site, PayPal. All your personal information is encrypted and protected. Bank transfer: this payment method will take approximately 5 days to be validated. Any charges applied by the bank are the client’s responsibility.
Cost in europe:
A 1.5 hours photoshoot costs 399 euros and not one cent more. A 129 euros deposit is to be made when you book your photoshoot, the remaining 270 euros are to be paid after the photoshoot.
Cost outside of europe:
A 1.5 hour private photoshoot outside of europe (for ex. New York) costs 499 euros and not one cent more. A 129 euros deposit is to be made when you book your photoshoot, the remaining 420 euros are to be paid after the photoshoot.
The photographer will edit your pictures (color, lights) and you will receive a download link via e-mail within 5-6 days after the photoshoot.
6. Product availability
You will be photographed in front of different backgrounds and from different angles for a final product of about 60 to 100 pictures. All pictures are normal edit (lights, contrast, color)! There is no beauty-editing or Photomontage! If you book our photographer more then 1,5 hours you well get arround 40 pictures/hour.
7. Cancellation Rights
In accordance with article L.121-20 of the consumer code, the client has 14 days to cancel their order without having to provide a reason or pay any fees. After receiving agreement from the client to complete their order, and in accordance with article L.121-20-2 of the consumer code, the right to cancellation does not apply to articles which are created following specific client instructions, or which are personalised and thus cannot be reused.
In the case of an error or fault in the execution of the order, the client has 14 days from the receipt of the order to make a complaint, detailling the exact nature of the mistake. If the complaint is accepted, “DAYLIGHTPHOTOGRAPHER” will proceed with a free replacement of the order, or it’s reimbursement, in which case the client must return the ordered articles in their original packaging, in a perfect condition and in their integrality. The replacement or reimbursement will then be given within five working days.
For privat clients: No delivery will be made without having received payment for the order. Two methods of delivery are available: the finished images will be sent to your e-mail address (via zip download) or by sending it through the post. Any delay in delivery will not be the reponsibility of “DAYLIGHTPHOTOGRAPHER” and will in no way constitute a reason for reimbursement or refusal of the “products”.
Any information you give us about yourself is saved by us purely in order to complete your order. No information you give us will be transmitted to any third party. Pursuant to the law 78-17 of the 6th January 1978, which relates to information technology, files and rights, you have the right to access, consult, modify, correct and delete any of the information which you have shared with us. 10. Intellectual property rights
This Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website and the Services) are protected by copyright, trade marks, patents and other intellectual property rights and laws. In accessing the Website you agree that you will access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.
